2. Data we process
Depending on the service requested and the status of the transaction, we may process:
- Identifying and contact data.
- Information about developments, properties, preferences and communications held.
- Financial and banking data, proof of payment, signatures and documentation necessary for reservations or purchases.
- Information about the origin of funds, when required by law.
- Data of co-owners, spouses, representatives, attorneys or other persons involved.
- Technical and browsing data obtained through cookies and similar technologies.
- Professional information included in CVs sent spontaneously.
3. Source
The data may come directly from the data subject —through the website, email, telephone, WhatsApp Business or other channels—; from social networks, advertising campaigns and real estate portals; or from the main buyer, when they provide data of other persons involved.
Anyone who provides third-party data declares that they are authorised to do so and that they have previously informed those persons.
4. Purposes and legal bases
4.1. Enquiries and follow-up
To handle requests, provide information about the development consulted, contact the data subject and carry out reasonable follow-up.
Legal basis: pre-contractual measures requested by the data subject and legitimate interest in handling and organising enquiries.
4.2. Commercial management
To incorporate the data into customer management tools to record communications, organise follow-ups, classify contacts and improve commercial management.
Legal basis: pre-contractual measures and legitimate interest in organising commercial activity.
4.3. Other developments
To send information about other developments by email, WhatsApp or telephone when the data subject expressly authorises it.
Legal basis: consent, which may be withdrawn at any time by writing to info@erkronhomes.com or through the mechanism included in the communication.
Giving this authorisation is voluntary and does not condition the handling of the initial enquiry.
4.4. Reservations and purchases
To identify the parties, collect and review documentation, prepare reservations and documents, manage signatures, coordinate the transaction, retain proof of payments made to the developer and manage incidents or claims.
Legal basis: pre-contractual measures, management of the corresponding legal relationship and compliance with legal obligations.
Erkron does not receive amounts on account of the price; payments are made directly to the corresponding developer company.
4.5. Communication to the developer company
When necessary to prepare or formalise a reservation or purchase, the necessary data and documents are communicated to the corresponding developer company.
The developer processes that data under its own responsibility, for the purposes that correspond to it as developer or seller.
Legal basis: pre-contractual measures, formalisation or execution of the transaction and compliance with legal obligations.
4.6. Cooperation in the prevention of money laundering
Erkron does not act as a real estate agent or intermediary in the transactions, so it does not have the status of an obliged party under Law 10/2010 on the prevention of money laundering. When this regulation applies to the transaction, it is the developer company that, where applicable, holds that status.
In that case, Erkron may collect identifying, financial and banking data and documentation on the origin of the funds, solely to pass them on to the developer company so that it can apply the identification and due diligence measures that correspond to it.
Legal basis: compliance with legal obligations and cooperation with the developer company in the formalisation of the transaction.
4.7. Surveys and statistics
To send satisfaction surveys by email or WhatsApp to clients and interested parties, and to prepare internal statistics on enquiries, developments, channels and commercial results.
Legal basis: legitimate interest in evaluating and improving services. The data subject may object at any time.
Aggregated and anonymous results may be retained without a time limit.
4.8. Job applications
To assess CVs sent spontaneously for present or future selection processes.
Legal basis: consent expressed through voluntary submission and pre-contractual measures requested by the candidate.
4.9. Claims and legal obligations
To handle incidents, claims and requirements, and to formulate, exercise or defend rights.
Legal basis: compliance with legal obligations and legitimate interest in defending rights.
5. Recipients
The following may access the data:
- Authorised staff of ERKRON GESTIÓN INMOBILIARIA S.L.
- The corresponding developer company, when necessary to manage a reservation or purchase.
- Providers of CRM, hosting, email, messaging, storage, maintenance, support, document management and electronic signature services working for Erkron.
- Public administrations, courts, security forces and other authorities, when there is a legal obligation.
The data is not communicated to other third parties except by legal obligation or a valid legal basis that permits it.
6. International transfers
Some technology providers may process data or allow access from countries outside the European Economic Area.
When these transfers occur, adequacy decisions, standard contractual clauses or other guarantees permitted by the regulations will be applied.

7. Retention
- Enquiries that do not result in a transaction: 24 months from the last interaction.
- Commercial communications: until consent is withdrawn.
- Reservations, purchases, signed documents and proofs: during the management of the transaction and the legal periods necessary to address liabilities.
- Prevention of money laundering: 10 years from the execution of the transaction, where applicable.
- Satisfaction surveys: 12 months from the response.
- CVs: 12 months from receipt.
- Claims: during their processing and the applicable legal limitation periods.
After these periods, the data is deleted or blocked exclusively to address legal liabilities.
8. Mandatory nature
The fields marked as mandatory are necessary to handle the request. If certain data or documents are missing, Erkron may be unable to respond, identify the parties or manage a reservation or purchase.
9. Rights
The data subject may exercise the rights of access, rectification, erasure, objection, restriction, portability and withdrawal of consent.
The request may be sent to info@erkronhomes.com or to C/ Monestir de Poblet, no. 10, 46015 Valencia, Spain. It must identify the applicant, indicate the right being exercised and provide sufficient information to locate the data.
Additional documentation to verify identity will only be requested when there are reasonable doubts.
The data subject may lodge a complaint with the Spanish Data Protection Agency.
10. Minors
The website is not specifically aimed at minors. Persons under 18 years of age must act through their parents, guardians or legal representatives when the request may lead to a reservation or purchase that they cannot validly formalise on their own.
11. Security
Erkron applies appropriate technical and organisational measures to protect the data against loss, alteration, disclosure or unauthorised access. Authorised staff and providers are subject to confidentiality obligations.
12. Amendments
Erkron may amend this policy when the regulations, the processing operations or its services change. The version in force is the one published on this page, with its update date.
